During debt collection, we consult and work closely with the client to develop a case strategy, carefully considering all relevant factors.

Non-litigious proceedings:

The first step in debt collection is always the payment notice sent to the debtor, which must contain information such as the amount, deadline, and where to pay, as well as consequences of non-payment. With the payment notice, we may also measure the debtor's willingness to pay and even the possibility of concluding an out-of-court settlement.

In the event of unsuccessful debt collection, the next level may be a payment order procedure before a notary (referred to as "FMH"), which is a simplified civil non-litigious procedure for enforcing money claims within the jurisdiction of a public notary. The payment order procedure was created by the legislator to enforce money claims quickly and effectively. The procedure of the notary has the same effect as a court procedure. If the claim does not exceed three million Hungarian Forints, only a payment order procedure can be initiated, and court proceedings cannot be started, except in the event of negotiating a settlement with the debtor. However, if the claim exceeds thirty million Hungarian Forints, court proceedings must be initiated in front of the regional court and a legal representation is mandatory. If the debtor does not object in the payment order procedure, the order becomes legally binding and enforceable and the enforcement of the decision can be initiated by the executor.

Litigation procedure:

In case where the debtor objects, the payment order procedure becomes a lawsuit. In this case, at the request of the court, an appeal must be submitted, in which the facts and legal arguments underlying the claim must be presented, supported by the necessary evidence.

Liquidation proceedings:

In case of invoiced claims against business associations, not only the procedures described above are available to our clients, but if the legal conditions are met, a liquidation procedure can also be initiated against the debtor company. The liquidation procedure is a non-litigation procedure in which creditors may receive compensation during the dissolution of the insolvent debtor without successors.

Based on our experiences, in most cases, the party acting with a legal representative is more successful in collecting claims from debtors due to an effective claims management procedure.
